Service Waiver & Risk Acknowledgement

This Service Waiver & Risk Acknowledgement applies to all trading cards, slabs and collectibles (“Items”) submitted to Card Care Australia (“Card Care”, “we”, “us” or “our”).
By purchasing a service, submitting an Item, or accepting this waiver, you acknowledge and agree to the following.
1. AUTHORISATION
You confirm that you are the legal owner of the submitted Item, or have authority from the legal owner to authorise the requested work.
You authorise Card Care to possess, inspect, handle, photograph and perform the services purchased or otherwise approved by you.
2. RESTORATION & CARD TREATMENT
Depending on the service selected and the condition of your Item, Card Care may perform processes including:
-
professional inspection and assessment;
-
surface cleaning;
-
fingerprint, oil, dust and debris removal;
-
polishing and micro-scratch reduction;
-
pressing and flattening;
-
dent and indentation correction;
-
crease correction or reduction;
-
corner and edge refinement;
-
corner lift, flick and ding correction;
-
controlled humidification or moisture treatment;
-
controlled heat treatment;
-
water-damage treatment;
-
removal from protective holders where reasonably required; and
-
other reasonable processes associated with the Card Care service purchased.
Not every process will be appropriate or performed on every Item.
You authorise Card Care to use its professional judgment when determining how to safely perform the service you have selected.
3. INHERENT RISKS
Trading cards are delicate collectibles. Their materials, age, condition, manufacturing characteristics, previous handling and previous treatments can affect how they respond to restoration.
You acknowledge that treatment may reveal or be affected by previously unknown or hidden conditions including:
-
structural or fibre weakness;
-
previous restoration or alteration;
-
moisture or water damage;
-
surface or coating instability;
-
ink, foil or print instability;
-
manufacturing defects;
-
previous chemical exposure;
-
adhesives or residues;
-
warping;
-
weakened edges or corners; and
-
other pre-existing conditions not reasonably identifiable before treatment.
Some damage may be irreversible or may only become apparent once work begins.
4. RESULTS ARE NOT GUARANTEED
Card Care will provide its services with the care and skill required by applicable law. However, due to the individual nature and condition of collectible cards, specific restoration outcomes cannot be guaranteed.
Some defects may be completely corrected, while others may only be reduced or may not be safely repairable.
Card Care does not guarantee:
-
complete removal of any defect;
-
improvement in monetary value;
-
preservation of existing market value;
-
any specific visual or condition outcome; or
-
any specific third-party grading outcome.
Any assessment or opinion provided by Card Care represents our professional assessment at that time and is not a guarantee of future grading, authentication or market value.
5. THIRD-PARTY GRADING
Card Care does not guarantee grades.
PSA, BGS, CGC, TAG and other grading or authentication companies operate independently from Card Care and determine their own grading standards, policies and outcomes.
Following our services, a card may receive:
-
a higher grade;
-
the same grade;
-
a lower grade;
-
a qualifier or designation;
-
an altered/restored determination;
-
no grade; or
-
another outcome determined by the grading company.
You acknowledge that grading standards and detection methods may change over time and that Card Care cannot control how any third party assesses an Item.
Card Care is therefore not responsible for a grading company's independent decision merely because the outcome differs from your expectations or Card Care's assessment.
6. PRE-EXISTING DAMAGE & PREVIOUS TREATMENTS
You should disclose any known previous restoration, cleaning, polishing, pressing, chemical treatment, moisture exposure, heat exposure, alteration or significant damage before work begins.
Card Care is not responsible for pre-existing damage or previously performed work merely because it is discovered or becomes visible during our service.
If continuing treatment presents an unreasonable risk to an Item, Card Care may stop work and contact you.
7. SLAB CRACKING
Where you purchase or authorise slab cracking, you expressly authorise Card Care to permanently open, crack, cut or otherwise compromise the slab for the purpose of removing the enclosed card.
You acknowledge that:
-
the original slab may be permanently destroyed;
-
existing encapsulation/certification may be affected;
-
labels, inserts and slab components may be damaged;
-
slab removal carries an inherent risk of accidental contact with the enclosed card; and
-
subsequent grading or re-encapsulation is not guaranteed.
Card Care will exercise reasonable care and skill when performing slab cracking.
8. DECLARED CARD VALUE
Where requested, you agree to provide a reasonable and accurate declared value for submitted Items.
A declared value does not constitute an appraisal or acceptance by Card Care of the Item's actual market value.
Card Care may refuse an Item or require additional handling, shipping, insurance or service arrangements for particularly valuable Items.
9. SHIPPING
Shipping and courier companies are independent third parties.
Customers are responsible for securely packaging Items sent to Card Care and are strongly encouraged to use tracked and appropriately insured shipping.
Responsibility for loss or damage occurring while an Item is in the custody of an independent carrier will be determined in accordance with applicable law, applicable insurance and the carrier's terms.
This does not exclude Card Care's responsibility for loss or damage for which Card Care is legally responsible.
10. PHOTOGRAPHY & DOCUMENTATION
Card Care may photograph or record submitted Items for identification, condition documentation, quality control, security, internal records and dispute resolution.
This clause does not by itself authorise Card Care to publicly disclose your personal information.
Any broader use of customer information remains subject to our Privacy Policy and applicable law.
11. LIMITATION & ASSUMPTION OF RISK
By submitting an Item, you acknowledge and voluntarily accept the inherent risks reasonably associated with the Card Care services you have authorised.
To the maximum extent permitted by law, Card Care is not responsible merely because:
-
a defect cannot be completely corrected;
-
an Item does not achieve an expected grade;
-
an Item's market value changes;
-
a third-party grader reaches an unexpected decision; or
-
a reasonable restoration outcome differs from your personal expectations.
Nothing in this waiver excludes Card Care's liability where that liability cannot lawfully be excluded.
12. AUSTRALIAN CONSUMER LAW
Our services come with rights and guarantees that may apply under the Australian Consumer Law.
Nothing in this Service Waiver or our Terms of Service excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or other applicable legislation.
13. ACCEPTANCE
By purchasing a Card Care service, submitting an Item to Card Care, or selecting the applicable acceptance checkbox, you confirm that:

you have read and understood this Service Waiver;

you understand the nature of the services being performed;
-
you understand that collectible restoration involves inherent risks;
-
you understand that restoration and grading outcomes cannot be guaranteed;
-
you voluntarily authorise Card Care to perform the services purchased or otherwise approved by you; and
-
you agree to be bound by this Service Waiver together with Card Care's applicable Terms of Service.
By submitting your Items to Card Care, you acknowledge that you are entrusting potentially valuable and irreplaceable collectible property to us for professional treatment and voluntarily authorise the work you have selected.
